Terms of Service

1. Acceptance of Terms

By accessing or using MobilesExchange ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Eligibility

You must be at least 18 years old to use MobilesExchange. By using the Platform, you represent that you:

• Are at least 18 years of age
• Have the legal capacity to enter into binding agreements
• Are located in the United States
• Will provide accurate and complete registration information

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. User Obligations

As a user of MobilesExchange, you agree to:

• Only list items you have the legal right to sell
• Provide accurate descriptions and photos of items
• Honor all agreed-upon transactions
• Not engage in fraud, misrepresentation, or deceptive practices
• Not list stolen, counterfeit, or illegal items
• Comply with all applicable laws and regulations

5. Prohibited Items

The following items are prohibited from being listed:

• Stolen devices or devices with active locks
• Devices with blacklisted IMEI numbers
• Counterfeit or replica items
• Items that infringe intellectual property rights
• Items that violate any laws or regulations

6. Transaction Methods

MobilesExchange offers two transaction methods:

• Local Meetup: Direct exchange between buyer and seller at a mutually agreed location
• Escrow Service: Platform-facilitated transaction with device inspection (see Escrow Terms)

7. Fees

Listing items is free. Escrow service fees apply as detailed in our Escrow Terms. Local meetup transactions may include an optional platform tip.

8. Limitation of Liability

MobilesExchange is a platform connecting buyers and sellers. We are not a party to transactions and are not responsible for:

• The quality, safety, or legality of items listed
• The accuracy of listings or user content
• The ability of sellers to complete sales or buyers to complete purchases
• Disputes between users (except for escrow-related disputes)

9. Account Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or harm the platform community.

10. Changes to Terms

We may update these terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated terms.
